Sean “Diddy” Combs is fighting being recently ruled to make a large payout in a sexual assault lawsuit against him.
According to court documents obtained by People, Combs filed an emergency motion to vacate a default judgment, a motion to dissolve a temporary restraining order, and a preliminary injunction.
Combs’ legal action comes in the wake of Derrick Lee Cardello-Smith winning a $100 million judgment for the alleged drugging and sexual assault by the music mogul in 1997.
“He looks forward to having this judgment swiftly dismissed, and that Lee Cardelo Smith had committed “fraud on the court,” Marc Agnifilo, an attorney for Combs, said in a statement according to The Guardian. According to the Detroit Metro Times, Cardello-Smith alleged that he was both drugged and sexually assaulted by Combs at a party in Detroit in 1997, just one claim amid a broader pattern of alleged sexual abuse and other aleged misconduct by the man once also known as “P Diddy,” “Puff Daddy” and “Love.”
On August 7, a preliminary court hearing was conducted virtually when Cardello-Smith, currently incarcerated, eventually sued over the alleged attack and provided information showing Sean Diddy Combs’ name on the prison visitation log. Additionally, Cardello-Smith said he offered him $2.3 million to dismiss the lawsuit, and that Sean Diddy Combs told him he would not acknowledge his claim in court. Cardello-Smith ultimately rejected the offer, saying, “Well, I disagree with how you get down”, in response to him saying, “You know how we get down.”
Judge Anna Marie Anzalone of the Lenawee County Circuit awarded the plaintiff the $100 million judgment when Combs failed to appear at the virtual hearing, The Metro Times reported. When defendants fail to take action in response to cases brought against them, plaintiffs receive default judgments in their favor.
Court records show multiple previous convictions of criminal sexual misconduct as well as one for kidnapping as Cardello-Smith is incarcerated at the Earnest C Brooks correctional facility. The Metro Times reported that Cardello-Smith taught himself criminal and civil law amid his incarceration while also developing “a long history of challenging the judicial system” with lawsuits. Other prominent defendants are named in those lawsuits besides Sean Diddy Combs. Another name in a lawsuit is the Roman Catholic Archdiocese of Detroit alleging that two of the priests along with one of its lay employees sexually abused him between 1979 and 1993 when he was about seven years old.
“His resume now includes committing fraud on the court from prison, as Sean Diddy Combs has never heard of him let alone been served with any lawsuit,” Agnifilo said.
Sean Diddy Combs has faced several other lawsuits accusing him of rape, sexual assaults, and other instances of physical violence, and distribution of “revenge porn.” He initially denied all allegations and pledged to “fight” to clear his name.
However, a security camera video was obtained by CNN showing him physically battering his then-singer and girlfriend Cassandra “Cassie” Ventura who sued him for damages several months earlier in 2016. Recently Sean Diddy Combs paid an undisclosed amount of money within one day of filing to settle Cassie Ventura’s claim accusing him of rape and severe physical abuse during a relationship that had ended.
Meanwhile, in March, federal authorities conducting a sex-trafficking investigation raided Sean Diddy Combs’sproperties in Los Angeles and Miami. Those investigators have not charged Combs with any crimes, though multiple media outlets on Monday reported that he had put up the raided Los Angeles home for sale at an asking price of $61.5m according to The Guardian.
